The general terms and conditions of sale below apply to Alltype Builders Merchants Ltd
1. GENERAL
These terms and conditions, which supersede all previous conditions, shall apply to all trading between Alltype Builders Merchants Ltd and the customer. Acceptance by Alltype Builders Merchants Ltd of an order is conditional upon acceptance by the customer of the following conditions, which override all other inconsistent terms or conditions, express or implied. No variation of these conditions shall be binding unless previously agreed in writing.
2. PRICE
A fixed price will not normally be quoted, but if it is, the price is subject to variation for increases in costs of materials, haulage, or wage rates after the quotation date. All quotations apply to the quantities specified. If an order is placed for different quantities, prices may be revised.
3. PAYMENT
(a) Unless the sale is for cash, accounts are due for payment by the last day of the month following the delivery date. Receipts are only recognised on an Alltype Builders Merchants Ltd printed form.
(b) Alltype Builders Merchants Ltd may refuse any order if payment arrangements or credit status are unsatisfactory. In cases of non-payment, refusal of delivery, insolvency, or related issues, all sums owed become immediately due and contracts may be cancelled or suspended.
(c) Interest at 2.5% per month (accruing daily) applies to overdue sums.
(d) Invoice disputes must be raised in writing before the payment due date. Customers may not withhold payments unrelated to disputed items.
(e) Goods normally held in stock may be returned in place of payment if in original and good condition.
(f) Cheques not paid upon first presentation incur a £25 charge.
(g) Credit card payments on credit accounts incur a 2% surcharge.
4. SET-OFF
Alltype Builders Merchants Ltd may set off sums owed to the customer against any sums owed by the customer.
5. EX-STOCK
Offers for ex-stock delivery are subject to goods remaining unsold.
6. DELIVERY – shortages/damages
(a) Customers must inspect goods on delivery or collection.
(b) Delivery is to the nearest point accessible by a safe hard road. Customers are responsible for risks when vehicles leave public roads. Labour for unloading must be provided by the customer. Delays or lack of assistance may incur extra charges.
(c) Alltype Builders Merchants Ltd is not liable for delays unless expressly agreed in writing. Delays due to manufacturers, strikes, fire, or force majeure are not the responsibility of Alltype Builders Merchants Ltd.
(d) Shortages, transit damage, or defects must be reported in writing within three days. Failure to do so deems goods accepted.
(e) Breaking bulk or unloading constitutes acceptance.
7. PACKING
(a) Some goods may pose health and safety risks; customers should request relevant information.
(b) Returnable packaging is credited when returned in good condition, carriage paid.
(c) Alltype Builders Merchants Ltd is not liable for defective packing from suppliers; customers must check packing adequacy.
8. MINIMUM CHARGE FOR SMALL QUANTITIES DELIVERED
A carriage charge may apply to orders under £150 including VAT.
9. CANCELLATION OF ORDERS
Non-stock items may only be cancelled with written agreement. Special-order, cut, or made-to-order goods cannot be cancelled.
10. RETURN OF GOODS
Incorrectly ordered or surplus goods are generally not accepted for return. Standard stock items may be accepted with a restocking charge and original packaging. Cement, lime, and plaster are non-returnable. Invoice details must be provided for credit.
11. STORAGE
Goods may be stored free for one month; afterwards storage and insurance charges apply.
12. MANUFACTURER’S GUARANTEES
Alltype Builders Merchants Ltd liability mirrors that of its suppliers. Exclusions and limitations apply as per the supplier’s terms.
13. MANUFACTURE TO ORDER
(a) Goods made to customer specifications carry no guarantee except compliance with those specifications. The customer indemnifies against IP breaches and third-party damage claims.
(b) Stress-rated products are warranted only to the advertised capacity.
(c) Claims must be made within three days of delivery.
14. SUB-CONTRACTING
Alltype Builders Merchants Ltd may sub-contract any order.
15. VARIATIONS IN QUANTITIES OF TIMBER
Deliveries may vary by ±15% with price adjusted accordingly.
16. SALES BY DESCRIPTION
Customers are solely responsible for suitability of goods. Catalogue descriptions indicate type only, without warranty.
17. SAMPLES
Samples represent general bulk only; variations may occur.
18. DEFECTIVE/FAULTY GOODS
(a) Defective goods will be repaired, replaced, or refunded if reported within 14 days and returned carriage paid. Liability excludes costs of removal/refixing.
(b) Total liability is limited to the contract price (except in cases of death/personal injury).
(c) No liability for economic, indirect, consequential, or third-party losses.
19. RESERVATION OF TITLE
(a) Goods remain the property of Alltype Builders Merchants Ltd until fully paid.
(b) Goods must be stored so they remain identifiable as Alltype Builders Merchants Ltd property.
(c) Alltype Builders Merchants Ltd may enter premises to repossess goods.
(d) Goods may only be sold in the normal course of business and proceeds held as fiduciary agent.
(e) Repossessed goods may be resold freely by Alltype Builders Merchants Ltd.
(f) Repossession extinguishes the customer’s liability for the purchase price, but not associated costs/damages.
20. RISK
Risk passes to the customer on delivery or collection. If goods are repossessed, risk passes back to Alltype Builders Merchants Ltd upon collection.
21. CONSUMER PROTECTION
Consumer statutory rights are not affected.
